### 5. OBJECTIVE AND RESPONSIBLE BODY
This privacy policy clarifies the nature, scope, and purpose of the processing (including collection, processing, and use, as well as obtaining consent) of personal data within our online offering and its associated websites, functions, and content (hereinafter referred to collectively as "online offering" or "website"). This privacy policy applies regardless of the domains, systems, platforms, and devices (e.g., desktop or mobile) on which the online offering is executed.

The provider of the online offering and the body responsible for data protection is **ACES4MEDIA Musikunterricht, Alexander Schwung, Poensgenstr. 17, 40764 Langenfeld** (hereinafter referred to as "Provider", "we", or "us"). For contact information, please refer to our Legal Notice (Imprint).

The term "User" includes all customers and visitors to our online offering. The terminology used, such as "User," is to be understood as gender-neutral.

In the following, we would like to inform you in detail about which data we collect, process, and use for which purpose and how you can object to this data processing.

### 6. GENERAL INFORMATION ON DATA PROCESSING
We process personal data of users (e.g., salutation, name, address, email address, telephone number, bank details, credit card number) only in accordance with the provisions of German and European Union (EU) data protection law and in accordance with the principles of data economy and data avoidance. This means that user data is only processed if there is a legal permission, in particular if the data is required for the provision of our contractual services or online services, is legally required, or if consent has been obtained.

We implement organizational, contractual, and technical security measures in accordance with the state of the art to ensure that the provisions of data protection laws are complied with and to protect the data processed by us against accidental or intentional manipulation, loss, destruction, or against access by unauthorized persons.

If content, tools, or other means from other providers (hereinafter referred to collectively as "Third-Party Providers") are used within the scope of this privacy policy and their registered office is located abroad, it is to be assumed that a data transfer to the countries in which the Third-Party Providers are based will take place. The transfer of data to third countries takes place either on the basis of a legal permission, the consent of the users, or special contractual clauses that guarantee the legally required security of the data.

The following regulations inform you about the purposes of processing, recipients, legal bases, storage periods, as well as your rights and the party responsible for your data processing. This privacy policy refers only to our websites. If you are redirected to other pages via links on our site, please inform yourself there about the respective handling of your data.

### 7. PROCESSING OF PERSONAL DATA
In addition to the uses explicitly mentioned in this privacy policy, personal data is processed for the following purposes based on legal permissions or user consent:
* The provision, execution, maintenance, optimization, and security of our services and user support;
* The provision of effective customer service and technical support.

We only transfer user data to third parties if this is necessary for billing purposes (e.g., to a payment service provider) or for other purposes necessary to fulfill our contractual obligations to users (e.g., providing address details to suppliers).

When contacting us (via contact form or email), the user's details are stored for the purpose of processing the inquiry and in the event that follow-up questions arise.

Personal data will be deleted once it has fulfilled its purpose and there are no legal retention obligations preventing its deletion.

### 8. SCOPE OF PROCESSING PERSONAL DATA
To ensure the functionality of our website and the provision of our content and services, it is necessary for us to collect and use personal data from our users.

Personal data is stored and processed exclusively on servers within the European Union. All data is encrypted using the SSL (Secure Sockets Layer) method.

Data processing is based on the legal provisions of Art. 6 (1) (a) (consent) and/or (f) (legitimate interest) of the GDPR. If processing is necessary to protect a legitimate interest of our company or a third party, and if the interests, fundamental rights, and freedoms of the data subject do not outweigh the former interest, Art. 6 (1) (f) GDPR serves as the legal basis for processing.

Any further use only takes place with the express consent of the customer. In detail, data is collected and processed as follows:

**Server Log Files**
When you visit our website, log file data transmitted to us via your browser is automatically collected and stored in an internal log file. This may include:
* Browser type and version
* Operating system type and version
* URL of the page through which you reached us
* Search terms used to find our site
* Date and time of access
* Names of the subpages you accessed.

We collect and process this data in anonymized form, meaning it cannot be assigned to a specific person. The purpose of this data collection is evaluation for internal system-related and statistical purposes, as well as for technical security (especially the defense against attacks on our web server) and abuse control. The IP address is only evaluated in the event of attacks on our network infrastructure.

**Email Address Usage**
We use your email address to complete registration processes via confirmation emails and to send you confirmation emails regarding the orders you have placed. The legal basis for this is Art. 6 (1) (b) GDPR (necessary for the performance of a contract).

**Payment Data**
Account or credit card data is used to process paid orders. The legal basis for this processing is Art. 6 (1) (b) GDPR (necessary for the performance of a contract).

**Contact Form / Email / Newsletter**
If you subscribe to our newsletter, the data in the input mask is transmitted to the controller. During registration, the user's IP address and the date/time of registration are stored to prevent misuse of the service or the email address. Data is not passed on to third parties unless there is a legal obligation to do so.

### 9. NEWSLETTER AND CONTACT FORM
The data will be used exclusively for sending the newsletter. The newsletter subscription can be cancelled by the data subject at any time. Likewise, the consent to the storage of personal data can be revoked at any time. For this purpose, a corresponding link can be found in each newsletter.

The legal basis for processing the data after the user has registered for the newsletter is Art. 6 (1) (a) GDPR, provided that the user has given consent. The legal basis for sending the newsletter as a result of the sale of goods or services is Section 7 (3) UWG (German Act Against Unfair Competition).

If you have consented to the use of your email address for receiving our newsletter and offers, you have given us the following declaration of consent, which we log.

**Contact via Form / Email:**
If you use the contact form on our website or contact us via email, the personal data you transmit will be stored automatically. This storage serves solely for the purpose of processing or contacting the data subject. No data is passed on to third parties. The legal basis for processing is Art. 6 (1) (a) GDPR if consent is given. The legal basis for processing data transmitted in the course of sending an email is Art. 6 (1) (f) GDPR. If the email contact aims at the conclusion of a contract, the additional legal basis is Art. 6 (1) (b) GDPR.

### 10. LEGAL BASIS FOR PROCESSING
* **Consent:** Art. 6 (1) (a) GDPR serves as the legal basis for processing operations for which we obtain consent.
* **Contract Fulfillment:** Art. 6 (1) (b) GDPR serves as the legal basis for processing necessary for the performance of a contract or for pre-contractual measures.
* **Legal Obligation:** Art. 6 (1) (c) GDPR applies if processing is necessary to fulfill a legal obligation to which our company is subject.
* **Legitimate Interest:** Art. 6 (1) (f) GDPR applies if processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests and fundamental rights of the data subject do not prevail.

### 11. RECIPIENTS OF DATA
After entering and transmitting your data, it reaches the server of an external service provider directly via an encrypted connection. Recipients of the data include:
* Public bodies that receive data due to legal regulations (e.g., social security institutions, tax authorities).
* Internal departments involved in the execution of business processes (HR, accounting, banking/payment providers, customer service, marketing, sales).

* **Right of Confirmation:** Every data subject has the right to obtain confirmation from the controller as to whether or not personal data concerning them is being processed.
* **Right of Access:** Every data subject has the right to obtain free information from the controller about their stored personal data and a copy of this information, including the purposes of processing, categories of data, and the planned storage duration.

**Right to Information on Data Transfers**
Furthermore, the data subject has the right to be informed whether personal data has been transferred to a third country or to an international organization. Where this is the case, the data subject shall also have the right to be informed of the appropriate safeguards relating to the transfer.

To exercise this right, the data subject may at any time contact an employee of the controller.

**c) Right to Rectification**
Each data subject has the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

**d) Right to Erasure (Right to be Forgotten)**
The data subject has the right to obtain from the controller the erasure of personal data concerning him or her without undue delay, and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:
* The personal data is no longer necessary in relation to the purposes for which it was collected.
* The data subject withdraws consent (Art. 6(1)(a) or Art. 9(2)(a) GDPR) and there is no other legal ground for processing.
* The data subject objects to the processing (Art. 21(1) GDPR) and there are no overriding legitimate grounds, or the data subject objects pursuant to Art. 21(2) GDPR (direct marketing).
* The personal data has been unlawfully processed.
* The personal data must be erased for compliance with a legal obligation in Union or Member State law.
* The personal data has been collected in relation to the offer of information society services (Art. 8(1) GDPR).

If one of the aforementioned reasons applies, the data subject may contact an employee of ACES4MEDIA at any time. We will ensure that the erasure request is complied with immediately.

Where ACES4MEDIA has made personal data public and is obliged pursuant to Art. 17(1) GDPR to erase the data, ACES4MEDIA shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data.

The data subject has the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used, and machine-readable format. He or she has the right to transmit those data to another controller without hindrance, provided the processing is based on consent or a contract and is carried out by automated means.

**g) Right to Object**
The data subject has the right to object, on grounds relating to his or her particular situation, at any time, to the processing of personal data concerning him or her which is based on Art. 6(1)(e) or (f) GDPR. This also applies to profiling based on these provisions.

If ACES4MEDIA processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to the processing of personal data concerning him or her for such marketing. This also applies to profiling to the extent that it is related to such direct marketing.

[Continuation of the text following your next input]

**h) Automated Individual Decision-Making, Including Profiling**
Each data subject shall have the right not to be subject to a decision based solely on automated processing—including profiling—which produces legal effects concerning him or her or similarly significantly affects him or her, provided that the decision (1) is not necessary for entering into, or performance of, a contract between the data subject and the controller, or (2) is authorized by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, or (3) is based on the data subject's explicit consent.

If the decision (1) is necessary for entering into or performing a contract, or (2) it is based on the data subject's explicit consent, ACES4MEDIA shall implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.

**i) Right to Withdraw Data Protection Consent**

### 21. DATA PROTECTION PROVISIONS: SOCIAL MEDIA COMPONENTS

**Facebook**
The controller has integrated components of Facebook on this website. Facebook is a social network. The operating company of Facebook for users outside the USA or Canada is **Meta Platforms Ireland Ltd.** (formerly Facebook Ireland Ltd.), 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Each time one of the individual pages of this website is called up on which a Facebook component (Facebook plug-in) has been integrated, the browser is automatically prompted to download a display of the corresponding Facebook component. During this technical process, Facebook is made aware of which specific sub-page of our website is visited by the data subject. If the data subject is logged into Facebook at the same time, Facebook recognizes which specific sub-page is being visited. This information is collected and assigned to the user's Facebook account. If you wish to prevent this, you must log out of Facebook before visiting our website.

**Instagram**
The controller has integrated components of the Instagram service. Instagram is an audiovisual platform. The operating company is **Meta Platforms Ireland Ltd.**, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
If the data subject is logged into Instagram, Instagram recognizes which sub-page is visited and assigns this information to the personal Instagram account. To prevent this, please log out of Instagram before visiting our site.

**Twitter (X)**
The controller has integrated components of Twitter (now "X"). Twitter is a multilingual, publicly accessible microblogging service. The operating company is **Twitter International Unlimited Company**, One Cumberland Place, Fenian Street, Dublin 2, D02 AX07, Ireland.
By using the Twitter button, Twitter receives information that you have visited our website. If you are logged into Twitter, this visit can be assigned to your account. To prevent this, log out of Twitter before visiting our website.

**YouTube**
The controller has integrated components of YouTube. YouTube is an internet video portal. The operating company is **Google Ireland Limited**, Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.

You can prevent this by logging out of your YouTube/Google account before visiting our website.

### 22. LEGAL BASIS OF PROCESSING
Art. 6(1)(a) GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party (e.g., for the delivery of goods or services), the processing is based on Art. 6(1)(b) GDPR. The same applies to processing operations necessary for carrying out pre-contractual measures (e.g., inquiries about our products).

### 23. DETAILED LEGAL BASES FOR PROCESSING
The processing of personal data is carried out based on the following legal grounds of the GDPR:
* **Art. 6(1)(a) GDPR:** Serves as the legal basis for processing operations for which we obtain consent for a specific purpose.
* **Art. 6(1)(b) GDPR:** Applies if processing is necessary for the performance of a contract (e.g., delivery of goods, provision of services) or for pre-contractual measures (e.g., inquiries about our products).
* **Art. 6(1)(c) GDPR:** Applies if our company is subject to a legal obligation requiring the processing of personal data, such as for the fulfillment of tax obligations.
* **Art. 6(1)(d) GDPR:** In rare cases, processing may be necessary to protect the vital interests of the data subject or another natural person (e.g., in the event of an accident on our premises).
* **Art. 6(1)(f) GDPR:** This is the legal basis for processing operations not covered by the above, where processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests and fundamental rights of the data subject do not prevail.

### 24. LEGITIMATE INTERESTS PURSUED BY THE CONTROLLER
Where the processing of personal data is based on Article 6(1)(f) GDPR, our legitimate interest is the performance of our business activities for the benefit of the well-being of our employees and shareholders.

### 25. DURATION OF STORAGE
The criterion for the duration of the storage of personal data is the respective statutory retention period. After the expiration of that period, the corresponding data is routinely deleted, provided it is no longer necessary for the fulfillment or initiation of a contract.

### 26. PROVISION OF DATA: STATUTORY OR CONTRACTUAL REQUIREMENTS
We clarify that the provision of personal data is partly required by law (e.g., tax regulations) or may result from contractual arrangements (e.g., information on the contractual partner). To conclude a contract, it may be necessary for a data subject to provide us with personal data which must subsequently be processed by us.
Failure to provide personal data would mean that the contract with the data subject could not be concluded. Before providing personal data, the data subject may contact us. We will clarify on a case-by-case basis whether the provision of personal data is required by law or contract, whether there is an obligation to provide the data, and what the consequences of failing to provide the data would be.

### 27. EXISTENCE OF AUTOMATED DECISION-MAKING
As a responsible company, we do not use automatic decision-making or profiling.
