1. Scope
These General Terms and Conditions (T&C) apply to all orders placed via the provider's websites in the field of digital audio products, in particular jingles, jingle packs, and individually created audio content.
2. Subject of Contract
The provider offers digital audio products for download as well as personalized jingles. Personalized products are created individually according to customer specifications (e.g., name of the attraction).
3. Conclusion of Contract
By completing the ordering process, the customer submits a binding offer. The contract is concluded upon successful payment.
4. Prices and Payment
All prices stated are final prices. Payment is made via the payment methods offered in the shop (e.g., PayPal).
5. Delivery
Delivery is exclusively digital:
Jingle Packs: Immediately after payment via download link.
Personalized Jingles: Via email within a short period after ordering.
No physical products will be shipped.
6. Intellectual Property & Usage Rights
This section is crucial for your protection:
Grant of Rights: Upon full payment, the customer receives a non-exclusive, non-transferable right to use the audio content for their own rides and business operations.
Prohibitions: Any transfer, resale, sublicensing, or reproduction of the content is prohibited.
Conceptual Protection: All creative services, drafts, and conceptual approaches remain the intellectual property of Aces4Media. The systematic imitation, replication, or "re-building" of our audio concepts and sound designs by third parties or competitors is strictly prohibited and constitutes a violation of copyright and unfair competition laws.
Reservation of Rights: Rights are only transferred upon full payment of the agreed fee.
7. Right of Withdrawal
For digital content, the right of withdrawal expires as soon as the execution of the contract has begun. The customer expressly agrees that the execution begins before the expiry of the withdrawal period.
8. Personalized Products
There is no right of withdrawal for individually created (personalized) jingles once production has started.
9. Liability
The provider is only liable for intent and gross negligence. No liability is assumed for technical problems on the part of the customer (e.g., playback devices, software).
10. Final Provisions
The law of the Federal Republic of Germany applies. Should individual provisions be ineffective, the effectiveness of the remaining provisions remains unaffected. Place of jurisdiction is Langenfeld, Germany.
